As per the Victor Valley Association of REALTORS® Bylaws the Nominating Committee has been appointed by President Caroll Yule with approval of the Board of Directors. The three REALTOR® members are as follows: Ann McDonald, Chair; Gene Gibbs and Jim Phillips. The candidates shall prepare a dual slate of candidates, if possible, for each vacant officer and director position. This slate of candidates must be completed prior to the May meeting. No person may be nominated for office unless they meet all of the qualifications for the office at the beginning of the term for which they are a nominee.
The Nominating Committees’ slate of candidates will be announced at the May general membership meeting and will be posted to the Membership through the official VVAR newsletter.
Additional qualified candidates for the vacant position may be placed on the Slate through the Nomination by Petition process. Nomination by petition requires that the authorized Petition Form be signed by at least 100 (One Hundred) REALTORS® of the REALTOR® membership. These forms will be available at the Association’s Business Office and will be accepted by the Association’s Executive Officer. The cut off for submission of petitions is 3:00P.M., June 27, 2008. Petitions CAN NOT be accepted after this date/time. If qualified, the names of the successful petitioning candidates will be placed on the ballot along with the other nominees, prior to the election date. The election will be conducted at the July General Membership Meeting.
To be nominated for President-Elect, Candidates must have been an active member of the Victor Valley Association of REALTORS® for three (3) years and shall have served as a local director for two (2) years or as a director for one (1) year and Secretary or Treasurer for one (1) year.
To be nominated for Secretary, Candidates must have been active members of the Victor Valley Association of REALTORS® for two (2) full years and have served as a director, or as a committee chairperson, or as a member of a standing committee for (1) full year.
To be nominated for all Director positions, all candidates must be active Victor Valley Association of REALTORS® members and have served as a chairman of a standing committee or served as a member of a standing committee for at least one (1) of the past two (2) years.
No elected officer or director shall serve more than two (2) consecutive terms. After one year has elapsed since service in office, such individuals are again eligible for election.
All qualifications for officers and directors may be waived subject to proof of equivalent service in another Association/Board of REALTORS® recommendation by the Nominating Committee and approval of the Board of Directors.
The offices to be filled for the 2008 election are: President-elect for 2009; Secretary a one (1) year term; and four (4) Directors for a two (2) year term.
On June 16th and June 17th the Association is offering the prestigious SRES® Designation, which is recognized by the National Association of REALTORS® and addresses the mature needs of homebuyers and sellers over 50.

Lockboxes
Just a REMINDER....everyone has been notified of the MLS Rule regarding the use of Lockboxes and we will issue fines for violation of the rule. PLEASE make sure that you are in compliance. We thank you for your cooperation.
Here is the rule:
Dear Members of the Victor Valley Multiple Listing Service,
There has been confusion to the MLS Rule about the Lockbox.
The rule reads as follows:
13.12 Lockbox Use (added by VVAR-approved by NAR). Participants /Subscribers of the Victor Valley Association of REALTORS® Multiple Listing Service have the right to place any lockbox or combination of lockboxes on a listed property provided the owner of the property consents to each such lockbox. In the event a participant/subscriber represents in the listing filed with the VVAR MLS that a lockbox is in use and available, and indicates same in the “showing instructions” field of the listing so that other participants/subscribers have access when showing the listed property, in addition to any other lockboxes located on the property, there must be a lockbox of the brand, model and type adopted as the common lockbox for the listings placed in the VVAR MLS. The current common lockbox is the Supra Ibox lockbox.
So, what does that mean?
1) The Property Owner must consent to each type of lockbox on the property.
2) If a member has indicated in the listing filed in the VVAR MLS that a lockbox is in use and available, and indicates that in the “showing instructions” field that there is a lockbox, there may be multiple boxes, but one must be a VVAR lockbox, which is the Supra Ibox.
3) If there is not a VVAR lockbox (Supra Ibox) on the property, the only comment the agent can make is to “Call Listing Office.”
4) No reference to any other type of lockbox can be made anywhere in the listing if there is not a VVAR lockbox (Supra Ibox) on the property.
5) Due to security a Combo Code should never be in the MLS listing, you should say “Call Listing Agent for access information.”
6) This policy will be strictly enforced and violations (Fines starting at $125.00) will be issued. The second FINE is $500.00....so make sure you are in compliance.
The Association has the right to:
1) Request to see the consent to place each type of lockbox on the property.
2) Request the ID Number of the Ibox and verify that it is in our database.

Listing Short Sales in the MLS
The California Model Multiple Listing Service (MLS) Rules include special guidelines for handling the unique situation posed by short sales. In a short sale, the lender considering a reduction in its loan payoff may request that the real estate agents also reduce their commissions. A listing broker needs not oblige but may nevertheless choose to do so to achieve the sale.
A listing broker who chooses to accept a reduced commission still is obligated to pay the cooperating broker the compensation published in the MLS, unless the listing broker also has included all of the following information in the MLS listing:
- The fact that the sale and gross commission are subject
to lender approval.
- The method by which the compensation offered through
the MLS will be reduced if the lender reduces the gross
commission.
As an example, a conditional offer of compensation for short sales may be placed in the "Remarks" section of the MLS as follows:
"Short sale and gross commission subject to lender approval. Any commission reduction to be split 50/50."
How the reduction is allocated in a short sale (e.g., 50/50 in th above example) is at the listing broker's sole discretion, as long as the cooperating broker is given notice of such allocation.

MEMBERSHIP CARDS
The Association has mailed out 2008 Membership Cards to all REALTOR and Affiliate Members. You will need to bring your Membership Card to the Breakfast Meetings for admittance. Membership meetings will be held every month on the 4th Wednesday at 7:00am, held at the Victor Valley Association of Realtors, 11890 Hesperia Rd., Hesperia.
If you have not received your card please contact the Association. New members your card will be mailed within two weeks of membership. Thank you for your cooperation.
Political Involvement at Local Level
The REALTOR® organization is there in front of the local city councils, county Board of Supervisors and legislators in Sacramento and Washington DC fighting ordinances and other laws that adversely impact the real estate industry and REALTORS® ability to conduct their business. In 2005 we added a Government Affairs Director, Mr. Chip Ahlswede, to guide and assist us with the needs of our growing community.
